CONTEST RULES

 

I.          Who Can Enter

 

1.   The parent must be a legal Texas resident who is 18 years or older, resides in Bastrop, Blanco, Burnet, Caldwell, Comal, Fayette, Gillespie, Hays, Lee, Llano, Mason, Travis, or Williamson County, and have lawful access to the method of entry set forth in these rules. The parent must nominate their own child who 7 is to 12 years of age and the child must reside in Bastrop, Blanco, Burnet, Caldwell, Comal, Fayette, Gillespie, Hays, Lee, Llano, Mason, Travis, or Williamson County.

 

2.   The parent must be able to bring the child to KTBC FOX 7 to appear on Good Day Austin during a weather segment between 7:00am – 9:00am on Tuesdays beginning October 11, 2011.

 

3.   Employees of NW Communications of Austin, Inc., on behalf of its station KTBC FOX 7 (the “Sponsor”), their affiliated companies, advertising and promotion agencies, and the immediate family and household members of each are ineligible.

 

 

II.         How to Enter

 

1.      No purchase is necessary to enter or win.  Only one entry per household per week. Only one winner per household.  The contest begins October 5, 2011 at 9am and will continue indefinitely until an end date is announced.

 

2.      To enter, go to www.myfoxaustin.com and look for the Weather tab.  Select “ZACK’S KIDCASTER” link on the drop down menu.  Register online by entering your myFOXaustin.com user name and ID and hit the “log-in” button. Then, click on the submission tab and send an essay of 125 words or less stating the reason they feel their child will be a good candidate for assisting Zack during the weather.  The essay must include: the parents’ name, date of birth, address and daytime contact number, and the name and birthday date of the child being nominated, a current picture of the child being nominated configured as a .jpeg file. Fill out the rest of the required fields, enter the code you see, and click the “submit” button.  Incomplete entries or entries with incompatible formats will be disqualified.  Entries remain for consideration for to duration of the contest. No incomplete entries will be accepted.

 

3.      If you are not already a registered user of myFOXaustin.com, you must create an online account as follows:  First, click the Registration tab and provide all the information as instructed.  Once your online account is successfully created, an Email Confirmation is sent to the email address that you provided.  You must respond to the Email Confirmation exactly as detailed in the message within 24 hours of creating your online account.  By responding to the Email Confirmation you are confirming that you wish to set up an online account with myFOXaustin.com.  If your email address is successfully verified by the web site, you are returned to www.myFOXaustin.com.  You may now access the giveaway entry form and enter the contest as described above.

 

4.      All submissions must be original and conform to Sponsor’s then-current standards and practices and policies as established or determined by Sponsor in its sole discretion.  Without limiting the foregoing, submissions may not contain profanity or references to violence, or demean any gender, race, religion or sexual orientation.  Entrants must own the copyright to, or otherwise have all necessary rights in, their entry materials.  Sponsor reserves the right to disqualify any entrant or remove any entry based on a claim of copyright infringement.  Entry constitutes an unlimited perpetual license to Sponsor to use entry materials, including, but not limited to, the right to copy, distribute, publicly perform and display the entry materials on its websites, television stations and in any and all media whether now known or hereinafter invented.

 

5.      Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry, winner(s) or other giveaway information by Sponsor or entrants for any reason whatsoever.  Sponsor is also not responsible for any injury or damage to any entrant’s or any other person’s computer related to or resulting from playing or downloading any materials in the giveaway or for entries that are late, misdirected or incomplete.  All entry materials may be maintained as part of KTBC’s giveaway records.  CAUTION:  ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE GIVEAWAY IS A VIOLATION OF THE CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.  Sponsor reserves the right to cancel or modify the giveaway if it becomes technically or otherwise corrupted.

 

6.      All entries that are illegible or are from ineligible entrants will be void. All entries become the property of NW Communications of Austin, Inc. (KTBC FOX 7) and will not be acknowledged or returned.

 

7.      Winners will be those with the best essays stating the reason they feel their child will be a good candidate for assisting Zack during the weather. Nominations not selected remain eligible for selection in subsequent weeks.  Child must be outgoing and able to communicate/hold conversations with adults. Child must not be camera shy. Child must not be easily disturbed by unfamiliar surroundings. If the child should become upset, uncommunicative or is unable to meet our on-air criteria, or if there is severe weather, breaking news stories, etc., then FOX7 reserves the right to discontinue the on-air portion of the promotion. The contest will be judged by FOX7 personnel, and the decisions of the judges will be final as to all matters including but not limited to whether a winner is eligible or whether an entry should be disqualified.

 

III.       Prize

 

1.      Each Wednesday of the contest, beginning October 5 we will pick a winner.  The winning child will appear live on air on the following Tuesday.  ERV of appearance: Priceless. 

 

2.      FOX 7 will try 3 times to contact the parent by phone 3.  The parent must sign complete and return the certification of eligibility and release and bring it on the Tuesday of the child’s appearance. If the parent cannot be reached by Friday of the week the child is selected, and bring the child and the signed and completed certification of eligibility and release on the following Tuesday, there will be no winner that week.  

 

3.      All entries that are illegible or are from ineligible entrants will be void. All entries become the property of NW Communications of Austin, Inc. (KTBC FOX 7) and will not be acknowledged or returned.

 

4.      Only one prize will be awarded per household. Individuals are eligible to win only one prize within any 30-day period, regardless of the number of giveaways entered.

 

 

IV.       Odds of Winning; Miscellaneous

 

1.      Odds of winning depend on the decisions of the judges.

 

2.      Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns, likenesses, and photographs for broadcast, online posting, and/or in any other media, including for advertising and publicity purposes, without additional compensation.

 

3.      Complete contest rules are available Monday through Friday during normal business hours at KTBC FOX 7, located at 119 E. 10th St., Austin, TX 78701 or at www.myFOXaustin.com through the duration of the contest.

 

4.      For a list of winners, send a separate, self-addressed, stamped envelope to: KTBC FOX 7, 119 E. 10th Street, Austin, TX 78701.

 

5.      This giveaway is subject to all applicable laws and regulations and is void where prohibited or restricted by law, including without limitation, in jurisdictions requiring registration, filing, trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these rules.  Sponsor is not responsible for typographical or other errors in the printing, offering, or administration of the giveaway, or in the announcement of the prize. The order in which entries are received will have no bearing on the selection of the winner.  In the event of a dispute over who submitted a particular entry, Sponsor will determine the entrant’s identity or select an alternate winner, in its sole discretion.

 

1.      By entering, participants represent that they are eligible, and agree (a) to be bound by these rules and the decisions of the judges, (b) to release Sponsors, their parent, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize, and (c) to Sponsors’ use of entrants’ personal information as described in the Privacy Policy located at www.myFOXaustin.com.
